2. Purpose

These General Terms and Conditions of Sale (GTCS) govern the sale of handmade children's clothing offered by Atelier Agapi on the website atelieragapi.com. Any order implies unconditional acceptance of these GTCS.

Atelier Agapi may modify these general terms and conditions of sale at any time, without notifying the customer. They take effect from the date of publication and will apply to all orders placed thereafter.

3. Products and Warranty

Our products are handcrafted artisan creations. Each piece is unique and may have slight variations compared to the photos shown on the website. These variations are part of the artisanal character of our creations.

Each item comes with a description and photos intended to be as accurate as possible. However, colors may vary, as they are displayed differently on different screens.

We disclaim all liability for any damages (direct, indirect, or consequential), losses, or expenses of any kind resulting from fraudulent manipulation by a third party that the customer may experience as a result of using the site.

In case of a manufacturing defect, please contact us within 30 days of receipt.

4. Orders

Orders can be placed directly on our online store. Any order constitutes acceptance of the prices and product descriptions available for sale.

We reserve the right to cancel or refuse any order from a customer with whom there is a dispute.

5. Prices

Prices are shown in euros (EUR), excluding shipping costs. We reserve the right to change our prices at any time, but products will be charged based on the rates in effect at the time of order confirmation.

Shipping costs include preparation, packaging, and postage fees. Shipping fees are calculated based on the order and the destination.

6. Payment

Payment is made online securely using the payment methods offered at the time of order. The order will only be confirmed after payment has been approved.

7. Production and delivery time

From the date of online order confirmation, Atelier Agapi commits to delivering the items within a maximum of 30 business days. Atelier Agapi reserves the right to adjust this time-frame according to its order schedule. The buyer will be notified if this period is extended. Any potential delays do not give the buyer the right to cancel the sale, refuse the goods, or claim damages.

However, if we are unable to supply the ordered products (for example, due to a shortage of a fabric), an amicable agreement will be proposed. If this is not possible, any costs incurred will be fully refunded to the buyer.

In the case of an exceptional delay, we commit to informing you as soon as possible.

8. Delivery

Deliveries are made to the address provided at the time of order. Delivery times are given for information purposes only and may vary depending on the destination.

Products travel at the recipient's risk. It is the customer's responsibility to check and properly receive the goods. Atelier Agapi cannot under any circumstances be held responsible for a delayed delivery, a damaged package, or a lost package. The buyer may then make any claim directly with the carrier, who is solely responsible, under the applicable legal regulations.

9. Right of withdrawal (14 days)

In accordance with European legislation (Articles L. 120-20), you have a period of 14 days from the receipt of your order to exercise your right of withdrawal without having to provide any justification.

To exercise this right, contact us by email at atelieragapi@gmail.com, indicating your order number.

Products must be returned in their original condition, unworn and unwashed, with their original packaging. Return costs are the responsibility of the customer.

The items will then be exchanged or fully refunded without penalty within 30 days, provided that no product has been damaged or worn.

Any custom or personalized order is not eligible for this right of withdrawal.

10. Product care 

Care instructions are provided on each product's page. Improper care will not be grounds for exchange or refund.

11. Intellectual Property

All elements of the website atelieragapi.com (texts, photos, logos, creations) are protected by copyright. Any reproduction, even partial, is prohibited without prior authorization.

12. Protection of Personal Data

The personal data collected during your order is necessary for processing it. In accordance with the GDPR, you have the right to access, rectify, and delete your data. To exercise these rights, contact us at atelieragapi@gmail.com.

13. Disputes

These Terms and Conditions are governed by French law. In case of a dispute, an amicable solution will be sought before any legal action.
